2. Electronic Signatures and Records

You acknowledge that electronic signatures carry the same legal weight as handwritten signatures under the E-SIGN Act (15 U.S.C. § 7001) and Uniform Electronic Transactions Act (UETA).

  • Clicking buttons such as 'I Agree,' 'Submit,' 'Purchase,' or 'Accept Policy' constitutes a legally binding signature.
  • Electronic records of your transactions will be deemed valid and enforceable.
  • Your electronic signature on insurance applications and claims forms has the same legal effect as a handwritten signature.

3. Consent to Receive Electronic Communications

ARRK and its underwriters are required by law to provide policyholders with certain documents, notices, and payments related to insurance marketing, coverage agreements, and policy administration. By consenting to electronic delivery, you agree to receive the following documents electronically:

  • Policy documents, terms, conditions, and endorsements.
  • Important policyholder notices and updates.
  • Coverage Selection/Rejection Forms for coverage options.
  • Premium invoices, billing statements, and payment confirmations.
  • Claim acknowledgments, updates, and related correspondence.
  • Cancellation and Nonrenewal Notices.
  • Premium Increase or Conditional Renewal Notices.
  • State-required notices, including privacy disclosures and regulatory updates.
  • Claim notices, proof of loss documentation, and settlement communications.
  • ID cards, certificates of insurance, and coverage verification documents.
  • Roadside assistance and emergency service notifications.

You are responsible for maintaining a valid email address and regularly checking for updates.

5. Hardware and Software Requirements

To conduct business electronically, you must have:

  • A computer or mobile device with internet access.
  • A web browser capable of accessing our website (we recommend Chrome, Firefox, Safari, or Edge).
  • Software to read and save PDF documents (e.g., Adobe Acrobat Reader).
  • A valid email account that you check regularly.
  • Sufficient storage space to retain electronic records as required.
  • The ability to download and print documents for your records.

By continuing with your transaction, you confirm that you meet these requirements.

6. Payment Authorization and Acknowledgment

  • By providing payment information, you authorize us to process payments electronically for insurance premiums, fees, and related charges.
  • Electronic payments are processed securely and are subject to your policy terms and billing arrangements.
  • You may set up automatic payment options for recurring premium payments.
  • Rejected or failed payments may result in fees, policy cancellation, or other actions as outlined in your policy terms.
  • You will receive electronic confirmations for all processed payments.
  • Refunds, when applicable, will be processed electronically to your original payment method.

7. Electronic Record Retention

You agree to retain electronic records of your insurance transactions as required by law and your policy terms.

  • You should download and save important documents to your device or print physical copies.
  • ARRK will maintain electronic records in accordance with legal requirements and industry standards.
  • You may request paper copies of electronic documents by contacting us, though fees may apply.
  • Electronic records will be available through your online account portal for the duration of your policy and as required by law.

8. Security and Data Protection

We implement industry-standard security measures to protect your electronic transactions and personal information:

  • SSL encryption for all data transmission.
  • Secure authentication protocols for account access.
  • Regular security monitoring and updates.
  • Compliance with applicable data protection regulations.
  • Secure storage of electronic records and signatures.

You are responsible for maintaining the security of your login credentials and notifying us immediately of any unauthorized access to your account.

9. Governing Law

This agreement is governed by the laws of the State of Washington and applicable federal regulations, including the E-SIGN Act and UETA.

Insurance-specific electronic transaction requirements are governed by the insurance laws of the state where your policy is issued.

10. Acknowledgment and Acceptance

  • You confirm that you have read, understand, and agree to this Voluntary Consent to Electronic Transactions, Signature, and Payments.
  • You acknowledge that your electronic signature is legally binding and has the same force and effect as a handwritten signature.
  • You confirm that you have the necessary technology to receive, access, and retain electronic records.
  • You understand that you may withdraw this consent at any time by contacting us, subject to the limitations described above.
  • You agree to promptly notify us of any changes to your email address or contact information.
